PostSomething Terms of Agreement
These Terms govern your use of PostSomething. By creating an account or using the Services, you agree to these Terms.
1. Acceptance
These General Terms of Agreement ("Terms") govern access to and use of PostSomething websites, applications, event tools, business profiles, premium services, QR codes, and related services (collectively, the "Services"). "PostSomething," "we," "us," and "our" mean A14U24ME.
By creating an account, accessing the Services, submitting content, registering for an event, joining a Deck, accepting a vendor invitation, or otherwise using PostSomething, you agree to these Terms. If you use the Services for an organization or business, you represent that you have authority to bind it. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 13 years old to create an account. If you are under the age of legal majority where you live, you may use the Services only with permission and supervision from a parent or legal guardian. The Services are not directed to children under 13.
You may not use the Services if your account was previously suspended or terminated unless A14U24ME authorizes your return.
3. Accounts
You agree to provide accurate, current information and keep it updated. You are responsible for:
- Protecting passwords, access codes, QR codes, and login credentials.
- Activity conducted through your account.
- People you authorize to manage profiles, Decks, businesses, events, or vendor pages.
- Promptly notifying us of unauthorized access.
Usernames, handles, event links, and similar identifiers are licensed for use and are not owned by users. We may reserve, rename, release, or reassign identifiers that are inactive, misleading, infringing, impersonating, or otherwise violate these Terms.
4. The Services
PostSomething may provide:
- User profiles, Cards, posts, media, comments, Takes, tags, votes, follows, bookmarks, and communities.
- Business Profiles, directories, testimonials, customer check-ins, and business communications.
- Basic and Premium Decks, private communities, memberships, announcements, and access requests.
- Event pages, Event Apps, passes, registration, check-ins, vendors, sponsors, staff, and team tools.
- Success Cards, Success Connect pages, lead tools, QR codes, contact sharing, and wallet features.
- Direct messages, email, browser push notifications, and related communications.
- Imported or linked event and product information, Premium features, coupons, and add-ons.
Features may be added, changed, limited, suspended, or discontinued. We do not guarantee that any feature will always remain available.
5. User Content
"User Content" includes text, Cards, comments, messages, images, videos, audio, links, business information, event details, vendor materials, testimonials, reviews, and other submitted content. You retain ownership of your User Content.
By submitting User Content, you grant A14U24ME a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, technically modify, display, distribute, and use it as necessary to operate, promote, secure, and improve the Services.
You represent that you own your User Content or have all permissions necessary to submit it. Content may remain where reasonably necessary for backups, legal compliance, security, transaction records, or other users' legitimate records.
6. Content and Conduct Standards
You may not submit, promote, or engage in content or conduct that:
- Is unlawful, fraudulent, deceptive, defamatory, threatening, harassing, or exploitative.
- Encourages violence, discrimination, or illegal activity.
- Contains nonconsensual intimate material or sexual content involving minors.
- Infringes copyrights, trademarks, privacy, publicity, or other rights.
- Impersonates another person, business, event, or organization.
- Contains malware, phishing, credential theft, spam, or harmful code.
- Misrepresents products, prices, sponsorships, event access, qualifications, or availability.
- Exposes another person's sensitive information without permission.
- Manipulates votes, rankings, follows, check-ins, registrations, or engagement.
- Circumvents access restrictions, bans, payments, or security controls.
You may not scrape, reverse engineer, overload, disrupt, or improperly access the Services.
7. Moderation and Enforcement
A14U24ME may investigate, restrict, label, remove, archive, or disable content or accounts when we reasonably believe they violate these Terms, create risk, infringe rights, or harm the Services or community. We may revoke Premium access, invalidate codes, preserve evidence, and cooperate with lawful investigations.
We are not obligated to monitor every submission and cannot guarantee that all objectionable content will be identified.
8. Copyright and Intellectual Property
PostSomething software, designs, branding, logos, interfaces, and original content are owned by A14U24ME or its licensors and are protected by intellectual-property laws. You may not copy, sell, reproduce, or create derivative works from them without permission.
Copyright complaints must identify the protected work and disputed material, provide the complainant's contact information and signature, and include good-faith and accuracy statements required by applicable law. Notices may be submitted through PostSomething's available support or account contact channels until a separate copyright address is published.
9. Businesses, Events, Decks, and Communities
Owners and managers are responsible for their pages, representations, rules, permissions, and authorized users. Businesses must accurately describe their identity, services, location, prices, availability, qualifications, and affiliations.
Deck owners are responsible for access requirements, viewer rules, private content, payment instructions, and approval decisions. Event organizers are responsible for event accuracy, venue arrangements, accessibility, permits, insurance, safety, security, age restrictions, refunds, vendors, staff, alcohol compliance, and applicable laws.
PostSomething does not endorse or guarantee any business, organizer, vendor, sponsor, event, product, Deck owner, or community.
10. Vendors and Event Teams
Organizers, vendors, sponsors, coordinators, staff members, and volunteers are independent parties. Their relationship is with each other, not with A14U24ME. Organizers are responsible for granting and removing management access.
Vendors are responsible for their products, services, licenses, taxes, customer communications, booth operations, fulfillment, and event compliance. A14U24ME is not responsible for organizer or vendor disputes, unpaid fees, cancellations, assignments, injuries, damaged property, or outcomes.
11. Check-Ins, Guest Information, and QR Codes
Check-in records, guest passes, Event Passes, Success Cards, invitation links, and QR codes are convenience tools. They do not guarantee identity, admission, payment, security clearance, or eligibility.
Businesses and organizers must obtain any required consent before entering or importing guest names, emails, phone numbers, payment records, or attendance information. Access codes and QR codes should be treated as confidential and may be invalidated when compromised or misused.
12. Payments and Third-Party Transactions
PostSomething may display payment, registration, donation, booking, contact, or commerce links supplied by users or third-party providers. Unless a checkout page expressly states otherwise, A14U24ME is not the seller, payment processor, merchant of record, event organizer, or party to transactions between users.
Payments completed through Zeffy, Stripe, Amazon, organizer websites, or other third parties are governed by that provider's terms and the seller's refund policy. Disputes involving third-party payments must generally be handled with the recipient or payment provider.
For fees paid directly to A14U24ME, the price, billing period, renewal terms, cancellation method, and refund policy displayed at checkout control. Unless otherwise disclosed or required by law, fees already charged are nonrefundable.
13. Premium Access and Promotions
Premium access may include Success Gold, Success Platinum, Success Black, Premium Decks, Business Profiles, Premium Events, add-on slots, and other benefits.
Promotional activations may expire automatically and may not renew automatically. Any future paid recurring product will renew only when clearly disclosed and affirmatively accepted at checkout. Premium access may end when its period expires, you deactivate it, a payment fails, a coupon is revoked, eligibility changes, or these Terms are violated.
Deactivation may return Premium Decks, Events, or Business Profiles to basic, inactive, pending, or restricted status. Coupons have no cash value and may be revoked for fraud, resale, transfer, or misuse.
14. Affiliate and Imported Content
PostSomething may display affiliate links and may earn compensation from qualifying purchases. Users publishing affiliate, sponsored, gifted, or compensated content are responsible for legally required disclosures.
Product prices, availability, discounts, warranties, and images may change. Event details may be imported from Eventbrite or public sources and may be incomplete or inaccurate. Confirm important information with the retailer or organizer.
Amazon, Eventbrite, Zeffy, Stripe, YouTube, and other referenced companies are independent third parties and do not necessarily sponsor or endorse PostSomething.
15. Communications
By providing contact information, you authorize transactional communications about your account, security, registrations, check-ins, invitations, access requests, and Services you use. Optional email and push communications may be controlled through available settings or unsubscribe methods.
Organizers and businesses must send lawful, relevant messages and honor consent and opt-out requirements. Message delivery is not guaranteed.
16. Privacy
Information intentionally placed on public profiles, Cards, business pages, event pages, comments, or directories may be viewed, copied, indexed, or shared by others. Privacy settings reduce visibility within the Services but cannot guarantee complete confidentiality.
A14U24ME may collect and process account, profile, location, communication, device, registration, check-in, payment-reference, and activity information as necessary to operate, secure, and improve the Services and comply with law.
17. Third-Party Links and Services
A14U24ME does not control third-party websites or services and is not responsible for their content, security, accessibility, privacy practices, availability, or transactions. Access is at your own risk and may be governed by separate terms.
18. Safety and Professional Advice
PostSomething does not perform background checks and does not guarantee identity, qualifications, licensing, insurance, products, services, or representations. Use reasonable judgment when meeting people, attending events, scanning codes, sharing information, or making payments.
Content is for general information and is not legal, medical, financial, tax, safety, or professional advice. For emergencies, contact appropriate emergency services rather than relying on PostSomething.
19. Account Deactivation and Termination
You may deactivate your account through available settings. Deactivation may prevent access but may not immediately delete all content or records. Information may be retained for legal compliance, fraud prevention, security, backups, financial records, and dispute resolution.
A14U24ME may suspend or terminate access when reasonably necessary to protect users, third parties, or the Services. Provisions intended to survive termination remain effective.
20. Service Availability and Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, A14U24ME disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, accuracy, security, and error-free operation.
We do not guarantee that content, messages, registrations, check-ins, event details, payment records, files, or account data will always be available or free from loss. Nothing excludes warranties that cannot legally be excluded.
21. Limitation of Liability
To the fullest extent permitted by law, A14U24ME and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, data, business, reputation, opportunities, or event revenue.
A14U24ME is not liable for user conduct, third-party transactions, event cancellations, vendor disputes, personal injury, property damage, unauthorized access, inaccurate listings, or content submitted by others.
To the fullest extent permitted by law, A14U24ME's total liability relating to the Services will not exceed the greater of the amount you paid directly to A14U24ME during the six months preceding the claim or one hundred U.S. dollars ($100).
22. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless A14U24ME and its affiliates from claims, damages, losses, liabilities, and reasonable legal expenses arising from your use of the Services, User Content, business or event activities, violation of these Terms, infringement of rights, or products, services, payments, and transactions you offer or arrange.
23. Governing Law and Disputes
These Terms are governed by applicable United States law and the law of the state in which A14U24ME is legally organized, without regard to conflict-of-law principles.
Before filing a claim, each party agrees to provide written notice through an available legal or support contact channel and allow at least 30 days for a good-faith attempt to resolve the dispute. Nothing prevents emergency injunctive relief or an eligible small-claims action.
24. Changes to These Terms
We may update these Terms as the Services or legal requirements change. Material changes will be communicated through the Services, email, or another reasonable method. The updated Terms will state their effective date. Continued use after that date constitutes acceptance where permitted by law.
25. General Provisions
These Terms and incorporated policies form the entire agreement regarding the Services. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver.
You may not transfer your rights without consent. A14U24ME may transfer these Terms as part of a merger, acquisition, restructuring, financing, or asset sale. Electronic acceptance and communications have the same effect as written acceptance and communications.
26. Contact
The Services are operated by A14U24ME. Until a dedicated legal mailing address and legal email are published, notices and support requests may be submitted through the contact, account, or support channels made available on PostSomething at postsomethin.com.
